Agreement to these terms
These Terms of Use (“Terms”) are an agreement between you and Wildframe (“Wildframe,” “we,” “us”). They govern your use of the Tock app and the Wildframe service that powers it. We have tried to write them in plain language rather than legalese.
By downloading, signing in to, or using Tock, you agree to these Terms and to our Privacy Policy, which explains how we handle your data. If you do not agree, please do not use Tock.
Eligibility
You must be at least 13 years old, or the minimum age required in your region, to use Tock. By using the app, you confirm that you meet this requirement and that you are able to enter into these Terms. If you are using Tock on behalf of someone else, you confirm you are authorized to accept these Terms for them.
Your account
Tock uses Sign in with Apple to create and secure your account. You are responsible for keeping access to your Apple ID secure, since anyone who can sign in with it can reach your Tock account.
You agree to provide accurate information and to use Tock only for your own account. You are responsible for the activity that happens under your account. If you believe your account has been accessed without your permission, contact us at [email protected].
License to use the app
Subject to these Terms, Wildframe grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Tock on Apple devices that you own or control, for your own non-commercial use.
This license does not transfer any ownership of Tock to you, and all rights not expressly granted are reserved by Wildframe.
Acceptable use
When using Tock, you agree not to:
- break the law, infringe others’ rights, or use Tock for any unlawful or harmful purpose;
- copy, modify, reverse-engineer, decompile, or attempt to extract the source code of the app, except where the law expressly allows it;
- resell, rent, sublicense, or otherwise commercially exploit Tock or any part of it;
- interfere with, disrupt, or place undue load on our servers, or try to gain unauthorized access to the service or other users’ accounts;
- use automated means to access or scrape the service, or circumvent any security or rate-limiting measures;
- remove or obscure any proprietary notices, or use our branding without permission.
Alarms and sleep tracking
Tock helps you schedule alarms and, if you choose, track your sleep. Alarms ring through local notifications on your device, so they depend on your device’s settings, including notification permissions, volume, Do Not Disturb and Focus modes, battery, and the device being powered on.
You are responsible for testing that alarms work the way you expect on your device. To the extent permitted by law, Wildframe is not liable for a missed alarm or for decisions you make based on your sleep data.
Intellectual property
Tock, including its software, design, text, graphics, the Wildframe name and logo, and all related intellectual property, is owned by Wildframe or its licensors and is protected by applicable laws. These Terms do not give you any rights to our trademarks or branding.
We welcome your feedback. If you send us suggestions or ideas about Tock, you agree we may use them to improve the service without any obligation or compensation to you.
Your data
The alarms, preferences, and sleep data you create stay yours. By using Tock, you grant Wildframe the limited permission needed to store, process, and sync that data so we can provide the app to you, as described in our Privacy Policy.
You can delete your data, or your whole account, at any time. See the Privacy Policy for how deletion works and how to request it.
Third-party services
Tock relies on services provided by Apple, including Sign in with Apple and the App Store. Your use of those services is also subject to Apple’s own terms and policies, and we are not responsible for them.
Because you get Tock through the App Store, Apple is a third-party beneficiary of these Terms and may enforce them. Apple has no obligation to provide support or maintenance for Tock.
Disclaimers
Tock is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We work hard to keep Tock reliable, but we do not warrant that it will be uninterrupted, error-free, or that alarms or sleep tracking will always perform exactly as expected. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Wildframe and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, sleep, or missed events, arising out of or relating to your use of (or inability to use) Tock.
Where liability cannot be excluded, Wildframe’s total liability to you for all claims relating to Tock is limited to the amount you paid us for the app in the twelve months before the claim, which, for a free app, may be zero. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold Wildframe harmless from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of Tock, your violation of these Terms, or your violation of any law or the rights of a third party.
Termination
You can stop using Tock at any time and delete your account from within the app or by contacting us. We may suspend or end your access to Tock if you breach these Terms, if needed to protect the service or other users, or if we discontinue the app.
When your account ends, the license granted to you stops, and the sections of these Terms that by their nature should survive, such as intellectual property, disclaimers, and limitation of liability, will continue to apply.
Changes to the app
Tock evolves over time. We may add, change, or remove features, or pause or discontinue the app or parts of it. Where reasonable, we will aim to give notice of significant changes, but we are not obligated to maintain any particular feature indefinitely.
Changes to these terms
We may update these Terms as Tock or the law changes. When we do, we will revise the “Last updated” date at the top of this page, and for material changes we will provide a more prominent notice. Your continued use of Tock after an update means you accept the revised Terms.
Governing law
These Terms are governed by the laws that apply where Wildframe is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections of the country you live in. If any part of these Terms is found unenforceable, the rest stays in effect.
